This End-User License Agreement ("Agreement") is a legal agreement between you and OVE CARE LIMITED ("Ove", "we", "us", or "our"), and not with Apple Inc. ("Apple") or Google LLC ("Google"). OVE CARE LIMITED, and not Apple or Google, is solely responsible for the Ove app (the "App") and its content. This Agreement provides you with a license to use the App on your mobile device under the terms set forth below. By downloading or using the App, you agree to be bound by these terms.
We grant you a non-transferable, non-exclusive license to use the App on Apple-branded products (like iPhone or iPad) or Android-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple App Store Terms of Service and Google Play Store Terms of Service. This license does not allow you to distribute or make the App available over a network where it could be used by multiple devices at the same time.
Ove is designed for teens. By using the App, you represent that you meet any applicable age requirements. Your privacy is important to us; please review our Data & Privacy Policy to understand how we collect, use, and protect your personal data, particularly sensitive health data.
Ove may offer certain premium features requiring a subscription. If you choose to purchase a subscription, the following terms apply:
Payment: Payment will be charged to your Apple ID or Google Play account at the confirmation of purchase.
Auto-Renewal: Your subscription will automatically renew at the same price and billing frequency (e.g., monthly, annually) unless auto-renew is turned off at least 24 hours before the end of the current period.
Cancellation: You can manage and cancel your subscriptions by going to your Account Settings on the App Store or Google Play Store after purchase. If you cancel, you will continue to have access to the premium features until the end of your current billing period.
Transparency: All prices and billing frequencies will be clearly disclosed to you prior to purchase within the App.
OVE CARE LIMITED is solely responsible for providing any maintenance and support services for the App, as specified in this Agreement or as required under applicable law. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the App.
The App is provided "as is" and "as available". OVE CARE LIMITED is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, and they may refund the purchase price for the App to you (if applicable). To the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation whatsoever with respect to the App.
You acknowledge that OVE CARE LIMITED, and not Apple or Google, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, OVE CARE LIMITED, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
You acknowledge and agree that Apple, Apple’s subsidiaries, and Google are third-party beneficiaries of this Agreement. Upon your acceptance of the terms and conditions of this Agreement, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
